OMNIBUS CLAIMS OBJECTION NOTICE

On August 21, 2008, the Receiver filed the Omnibus Claims Objection Notice with the court. 

If you returned your Claim Form and checked one of the boxes indicating that you objected to the amount recommended by the Receiver, on August 21, 2008 a letter was mailed notifying you that the Receiver is going to object to your claim in part.  If you do not agree with the Receiver’s objection and would like to challenge it, you must respond to the letter by September 22, 2008.  If you do not want to continue with your objection, you do not need to respond to this letter. 

The Receiver’s objection was based on one or more categories.  You may click here to search (by NME/Claim Number, AP/CF number, or Reason for Objection) to see if the Receiver has an objection to your Claim Form and, if so, to see which category your objection falls into.

CLAIM FORM:

On April 22, 2008, claim forms were mailed to all known investors, creditors and other claimants.  The forms were mailed to the last known address on file with the Receiver.  You had until July 22, 2008 to return a completed claim form to The Garden City Group, Inc.

SPECIAL NOTES: 

       ■ The claim form(s) have no effect on whether you are on a Keep or a Sell policy.  If you are on a Keep policy, you should continue to remit your administrative fees and premium obligations as invoiced.  If you are on a Sell policy, the sale proceeds will represent a separate distribution to those investors.

       ■ The claim form(s) are not a notice that your policy has matured.  Should your policy mature, you will be notified of the maturity under separate cover.

CONFIRMATION POSTING AND EMAIL

A list of all claim forms received (numerically listed by claim number) will be posted on the Receiver’s website.  If you submitted your claim form(s) by email (to: mbcclaims@gardencitygroup.com), you will receive an email response confirming receipt.  If you submitted your claim form(s) by postal mail, you will not receive a direct confirmation from the Receiver.  Please feel free to use the acknowledgement services of the applicable mail carrier (return receipt request, confirmation request, etc).  You should maintain a photocopy of the form and any additional documents submitted for your personal records.
