NOTICE OF SUPPLEMENTAL DISTRIBUTION
The Receiver has asked the Court for authorization to utilize additional funds that have been recovered, as well as funds that have gone unclaimed in the original distribution process, to make a distribution to investors who were not included in the original distribution because they failed to return a claim form. These are investors who would have been entitled to a share of the distribution if they had returned their claim form but, for one reason or another, did not do so. If the Court approves the Receiver’s request, the supplemental distribution will be made to the investors, on the PDF below, who have contacted the Receiver since the original distribution was made. OMNIBUS CLAIMS OBJECTION NOTICE
On August 21, 2008, the Receiver filed the Omnibus Claims Objection Notice with the court.
If you returned your Claim Form and checked one of the boxes indicating that you objected to the amount recommended by the Receiver, on August 21, 2008 a letter was mailed notifying you that the Receiver is going to object to your claim in part. If you do not agree with the Receiver’s objection and would like to challenge it, you must respond to the letter by September 22, 2008. If you do not want to continue with your objection, you do not need to respond to this letter.
The Receiver’s objection was based on one or more categories. You may click here to search (by NME/Claim Number, AP/CF number, or Reason for Objection) to see if the Receiver has an objection to your Claim Form and, if so, to see which category your objection falls into.
A list of all claim forms received (numerically listed by claim number) will be posted on the Receiver’s website. If you submitted your claim form(s) by email (to: email@example.com), you will receive an email response confirming receipt. If you submitted your claim form(s) by postal mail, you will not receive a direct confirmation from the Receiver. Please feel free to use the acknowledgement services of the applicable mail carrier (return receipt request, confirmation request, etc). You should maintain a photocopy of the form and any additional documents submitted for your personal records.
If you have submitted a claim form and have NOT received a
confirmation (listed on the website or by email) within 30 days of your
submission, please wait an additional two weeks before contacting us.
